Abstract: Digital trade and global data governance are at a pivotal moment, raising complex challenges for policymakers and regulators worldwide. This workshop—jointly organized by the Competition and Innovation Lab at GWU, Collegio Carlo Alberto, and the ITC-ILO Master in Trade Law—draws on insights from the new book by Neha Mishra (Assistant Professor in the International Law Department at the Graduate Institute, Geneva), which examines five key policy areas at the intersection of digital trade and data governance: privacy, cybersecurity, governmental access to data, the data divide, and competition. Through a comparative analysis of domestic regulatory approaches and their interplay with international trade rules, Neha Mishra will discuss the legal alignment challenges and opportunities in each area with Professor Cristina Poncibò (Collegio Carlo Alberto, University of Torino) and Oscar Borgogno (Banca d’Italia, GWU). The discussion will focus on the central thesis of her book, which proposes a multilayered framework for reconciling international trade law with emerging global norms—highlighting the role trade rules can play in fostering regulatory cooperation and supporting a more coherent transnational data governance regime.
